1. Information Collected and Stored by the Application
THE AMAZONASSIST APPLICATION COLLECTS AND STORES FULL UNIFORM RESOURCE LOCATORS ("URLS") FOR CERTAIN WEB PAGES YOU VISIT. BY COLLECTING URLS, THE AMAZONASSIST APPLICATION TRACKS AND COLLECTS A RECORD OF USERS' WEB BROWSING ACTIVITY WITHIN AND ACROSS WEBSITES. AMAZONASSIST ALSO COLLECTS AND STORES OTHER USER INFORMATION YOU GIVE WHEN YOU DOWNLOAD AND INSTALL THE SOFTWARE AND INFORMATION YOU ENTER INTO THE APPLICATION AND ON CERTAIN SITES. THE AMAZONASSIST APPLICATION ONLY COLLECTS INFORMATION FROM SITES WITH WHICH THE APPLICATION IS PROGRAMMED TO OPERATE, INCLUDING MAJOR SEARCH ENGINE SITES. IF YOU HAVE AN AMAZON COOKIE, WE ARE ABLE TO ASSOCIATE YOUR IDENTITY AND ACCOUNT INFORMATION WITH YOUR AMAZONASSIST WEB BROWSING ACTIVITY. IF YOU WOULD NOT LIKE YOUR IDENTITY AND ACCOUNT INFORMATION ASSOCIATED WITH YOUR AMAZONASSIST WEB BROWSING ACTIVITY, YOU MAY CHOOSE TO OPT-OUT THROUGH THE APPLICATION. ALTHOUGH YOUR WEB BROWSING ACTIVITY WILL STILL BE COLLECTED WHILE THE APPLICATION IS ACTIVE, SUCH INFORMATION WILL NOT BE ASSOCIATED WITH YOUR IDENTITY AND ACCOUNT INFORMATION.
IN ADDITION, THE AMAZONASSIST APPLICATION PROVIDES AMAZON WITH CERTAIN AUTOMATIC INFORMATION ABOUT YOUR COMPUTER AS DESCRIBED IN THE AMAZON.COM PRIVACY NOTICE.
2. Privacy Policy
AMAZON KNOWS THAT YOU CARE HOW INFORMATION ABOUT YOU IS USED AND SHARED, AND AMAZON APPRECIATES YOUR TRUST THAT AMAZON WILL DO SO CAREFULLY AND SENSIBLY. INFORMATION COLLECTED THROUGH THE APPLICATION IS SUBJECT TO THE AMAZON.COM PRIVACY NOTICE, WHICH IS INCORPORATED INTO AND MADE A PART OF THIS AGREEMENT. 3. The AmazonAssist Application
The AmazonAssist application (together with any updates or upgrades, the "Application") is offered by Amazon Services LLC ("Amazon") and is a downloadable software application that functions as an add-on to the Mozilla Firefox browser. When installed and enabled, the Application will detect the terms ("Search Terms") that you enter into either the search field of certain websites that the Application is programmed to support (collectively, "Supported Third Party Sites"), which may change from time to time, or the Application's own search field, and will display to you products that are related to those Search Terms and that are available on www.amazon.com. The terms of the Agreement govern the Application and any updates or upgrades to the Application that Amazon may provide that replace and/or supplement the original Application, unless such update or upgrade is accompanied by a separate license, in which case the terms of that license will govern.
4. Beta Version
You acknowledge that the Application is a beta version and therefore does not represent final product from Amazon and may contain bugs, errors, and other problems that could cause system or other failures and data loss. If you provide feedback to Amazon, you hereby irrevocably assign to Amazon or its affiliates, and Amazon or its affiliates will own, all right, title, and interest in and to all such feedback, even if you have designated it as confidential.
5. License and Restrictions
Subject to your compliance with the terms of the Agreement, Amazon grants you a non-exclusive, non-transferable, non-sublicensable, limited right and license to install and use the Application on your computer. You may not make copies of or distribute the Application or electronically transfer the Application from one computer to another or over a network. Except and only to the extent expressly permitted under the Agreement or application law, you may not, and may encourage, assist, or authorize any other person to, modify, reverse engineer, decompile, or disassemble the Application, in whole or in part; create any derivative work from or of the Application; or bypass, modify, defeat or tamper with or circumvent any of the functions or protections of the Application. You may not rent, lease, sublicense, assign, or transfer the Application or your rights in the Application, or authorize all or any portion of the Application to be copied onto another user's computer. However, you may transfer all of your rights to use the Application to another person or legal entity if you (a) also transfer the Agreement and the Application, including all copies, updates, and prior versions, to such person or entity; (b) you do not retain any copies of the Application; and (c) the receiving person or entity accepts the terms of the Agreement. You may not use the Application for any illegal purpose. You will comply with all export and re-export restrictions and regulations of the Department of Commerce and other United States agencies and authorities, and not to transfer, or encourage, assist, or authorize the transfer of, the Application to a prohibited country or otherwise in violation of any such restrictions or regulations.
6. Updates
In order to keep the Application up-to-date, Amazon may automatically update or upgrade the Application at any time and without notice to you. Further, Amazon may change, suspend, or discontinue the Application, or any part of the Application without notice or liability. Amazon may in its sole discretion, but has no obligation to, provide you with customer support. If Amazon elects to provide support of any kind, it may terminate that support at any time without notice to you.
7. Government End Users
The Application is a "Commercial Item" as that term is defined in 48 C.F.R. § 2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation," as such terms are used in 48 C.F.R. § 12.212 or 48 C.F.R. § 227.7202, as applicable. Consistent with these provisions, the Application is licensed to U.S. Government end users (a) only as a Commercial Item, and (b) with only those rights as are granted to all other end users pursuant to the terms of the Agreement. Unpublished-rights reserved under U.S. copyright laws.
8. Intellectual Property Ownership
The Application is the intellectual property of Amazon or its affiliates and its and their licensors. The structure, organization, and code of the Application are valuable trade secrets and confidential information of Amazon and its affiliates. The Application is protected by law, including without limitation copyright laws and international treaty provisions. Except as expressly stated herein, the Agreement does not grant you any intellectual property or other rights in the Application, and all rights not expressly granted in the Agreement are reserved by Amazon and its affiliates.
9. Termination
You may terminate the Agreement at any time by uninstalling or destroying all copies of the Application that are in your possession or control. In addition, your rights under the Agreement will automatically terminate without notice from Amazon if you fail to comply with any term of the Agreement or if Amazon discontinues the Application. In case of any termination, you must cease all use of the Application. Amazon may also terminate your right to use the Application at any time, and in such event may modify it to make it inoperable.
10. Disclaimer of Warranties
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT INSTALLATION AND USE OF, AND ANY OTHER ACCESS TO, THE APPLICATION IS AT YOUR SOLE RISK. THE APPLICATION IS DELIVERED TO YOU AS IS WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND AMAZON AND ITS AFFILIATES AND LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY AMAZON OR AN AUTHORIZED REPRESENTATIVE OF AMAZON WILL CREATE A WARRANTY. THE LAWS OF CERTAIN JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
11. Limitation of Liability
TO THE EXTENT NOT PROHIBITED BY LAW, NEITHER AMAZON NOR ITS AFFILIATES OR LICENSORS WILL BE LIABLE TO YOU FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES FOR BREACH OF ANY EXPRESS OR IMPLIED WARRANTY, BREACH OF CONTRACT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY RELATED TO THE APPLICATION, INCLUDING WITHOUT LIMITATION ANY DAMAGES ARISING OUT OF LOSS OF PROFITS, REVENUE, DATA, OR USE OF THE APPLICATION, EVEN IF AMAZON HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, AMAZON'S AGGREGATE LIABILITY UNDER THE AGREEMENT WILL BE LIMITED TO $5.00. THE LAWS OF CERTAIN JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
12. Indemnification
You will defend, indemnify, and hold harmless Amazon and its affiliates, and its and their licensors, officers, directors, agents, and employees, from and against any liability, loss, damage, cost, or expense (including reasonable attorneys' fees) arising out of your use of the Application, violation of the Agreement, violation of applicable law, or violation of any right of any person or entity, including without limitation intellectual property rights.
13. Governing Law
The laws of the state of Washington, without regard to principles of conflict of laws, will govern the Agreement and any dispute of any sort that might arise between you and Amazon.
14. Disputes
Any dispute relating in any way to you're the Application in which the aggregate total claim for relief sought on behalf of one or more parties exceeds $7,500 will be adjudicated in any state or federal court in King County, Washington, and you consent to exclusive jurisdiction and venue in such courts.
15. Miscellaneous Provisions
Amazon reserves the right to modify, suspend, or discontinue the Application, or any part of the Application, at any time and without notice to you. Amazon will not be liable to you should it exercise such right. Amazon reserves the right to make changes to the Agreement at any time by posting the revised terms on the Amazon.com website. Your continued use of the Application following any such changes will constitute your acceptance of those changes. Amazon's failure to enforce your strict compliance with the Agreement will not constitute a waiver of any of its rights. If any term of this Agreement is found invalid, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining terms.
16. Dojo License and Additional Disclaimers
Portions of the Application are subject to the following open source license, which applies only to those portions of the Application that are licensed to Amazon under the Dojo Foundation license:
